The Background

Mirena migration injuries are more likely to occur in younger women, according to a new study published in the Obstetrics & Gynecology journal. More than half of 2,000 Mirena lawsuits filed in federal and state courts allege that the design defect allows the intrauterine birth control device to eject voluntarily and migrate. Since 2008, over 5,000 women have informed the FDA that the IUD moved out of the uterine cavity on its own and caused serious injuries to other body parts while migrating. Research Warns Teens of Mirena Migration Injury, Rejects AAP Advisory

Reported in October 2014, the latest study warns that the risk of IUD expulsion is higher in users aged between 14 and 19. Of 5,400 case studies of Mirena and Paragard users studied, one in every 10 found her IUD displaced over a period of 36 months. An investigation showed the prominent role of the age factor in enhancing the menace of ejection. Teens face two-fold expulsion and injury risk than those in their 20s and 30s. The study corroborates the findings of two earlier studies, where doctors stopped short of recommending the IUD to women who had not yet given birth fearing Mirena migration injuries.

The latest revelations came in the backdrop of the recommendations by the American Academy of Pediatrics advocating use of Mirena and similar IUD birth controls by young women. Last month, the AAP advises doctors to appraise IUD benefits to teens and their guardians considering birth control pills. It suggested that teens should consider long-term pregnancy prevention methods, such as Mirena IUDs, to avoid everyday action that many tend to forget.

The study indicating higher chance of unexpected expulsion that may accompany serious injuries and potential risk of uterus damage raises concern over safety of birth control IUDs. Though the AAP advisory mentioned the possibility of infection linked to the IUD, it did not address the growing fears relating to spontaneous Mirena migration, which had played havoc with thousands of women rendering them childless or live with debilitating internal injuries.

An analysis of the MedWatch reports indicates as many as 72,000 Mirena side effect complaints made their way to the FDA since the IUD birth control was launched in 2000. About 47,000 adverse events reported in the last five years claimed Mirena migration while at least 1,300 users had uterus perforations during the same time. Actual figures may be much higher as many about 90% of such events go unreported.

More than 1,300 women have undergone hysterectomy and other invasive procedures since 2007 following Mirena perforation of their uterus. Hundreds of women have filed Mirena lawsuits claiming that the levonorgestrel birth control IUD they selected to prevent pregnancy cut through their uterus, fallopian tube, and other pelvic organs, causing them to suffer health hazards. Media reports indicate at least 5,000 women had experienced serious health problems and one or more surgical interventions to treat internal injuries linked to Mirena migration and perforation.

Design Defect Reason for Mirena Perforation

The T-shaped Mirena birth control device is implanted in the uterus. Levonorgestrel hormone released from the contraceptive IUD steadily thickens the cervical mucus that obstructs movement of sperms into the fallopian tube and thus prevents fertilization. Once inserted, the birth control IUD is expected to check unwanted pregnancy for five years.

However, many users have claimed that the design defect allows Mirena IUD to spontaneously dislodge and migrate from its place of insertion and cause extensive injuries. A 2013 report prepared by DrugRisk, a consumer watchdog on adverse events related to prescription drug injuries, highlighted a 17 percent increase in the number of Mirena perforation injury claims compared to the year before.

The American Journal of Obstetrics and Gynecology reported a number of case studies in February 2013 warning of life-long-term adverse impacts on young women due to Mirena perforation of their internal organs and consequent surgeries. The Society of Laparoendoscopic Surgeons also advised all laparoscopy and endoscopy professionals registered with it about the potential danger of Mirena perforations rendering permanent damage to reproductive organs.

Mirena Lawsuits: New MDL Sought Over Brain Injury

On May 27, 2014, the Judicial Panel on Multidistrict Litigation was approached by nine plaintiffs seeking a second Mirena lawsuit MDL. The separate consolidation was sought for Mirena lawsuits filed for brain injury side effects. Idiopathic intracranial hypertension (IIH) is a neurological disorder attributed to enhanced intracranial pressure inside the skull. When the cerebrospinal fluid level shot up due to levonorgestrel released by Mirena IUD, users suffer from pain in the brain, inflammation of the optical disk, migraine, and vision disorder. About a dozen of such litigations are filed by women who experienced IIH while using Mirena IUD and at least 60 more such litigations are expected soon.

Mirena Lawsuit: IUD Linked to Brain Injury, Neurological Disorders

Mirena birth control device promoted by manufacturer Bayer as a safe way to prevent pregnancy has been blamed for causing brain injuries. A number of Mirena lawsuits have been filed in the recent months, alleging that the intrauterine device led to neurological disorders, vision loss, and tumor-like symptoms in users. Bayer faces over 2,000 Mirena lawsuits blaming that the defective contraceptive for migration, uterine wall perforation, and embedment with internal organs, which forced users to undergo surgical interventions, including hysterectomy.

Mirena Brain Injury Lawsuit

Nine women have filed Mirena lawsuits seeking product liability against Bayer claiming that they suffered from adverse neurological conditions after receiving the IUD. These petitioners have also requested the federal multidistrict panel to set up a separate MDL for pretrial consolidation of Mirena lawsuits linking the contraceptive device to brain disorders. According to them, at least 65 other women had similar brain problems linked to their use of the preventative and they are preparing to join the litigation.

Mirena brain injury lawsuits allege that levonorgestrel steroid hormone released from the birth control device caused users to develop idiopathic intracranial hypertension (IIH), a neurological disorder that impacts the functioning of the brain. Levonorgestrel packed in the T-shaped polyethylene IUD leads to enhanced cerebrospinal fluid levels, which increases intracranial pressure in the skull. Users experience brain pain similar to the one caused by tumors.

IIH also results in severe migraine that lasts for days, swelling of the optic disk, non-stroke neurological disorders, and vision loss symptoms, including temporary blindness. Users reportedly suffered from tinnitus or ringing-like sensation in the ears after using Mirena IUD. Scientific studies have linked all these symptoms to elevated pressure in the skull attributed to cerebrospinal fluid build-up.

“Because Mirena’s IUS label is devoid of any warnings of IIH, once a patient’s healthcare provider rules out transient cerebral ischemia or stroke as a cause of symptoms of migraine and/or asymmetrical visual loss, the healthcare provide will not typically know or advise a patient with IIH to remove Mirena IUS, which causes or contributes to the development and/or progression of IIH,” the petition seeking centralized consolidation of Mirena brain injury lawsuits claims.

Mirena Birth Control IUD Injury Reports

Mirena birth control was introduced in 2000. The IUD soon became a popular contraceptive option among women looking for long-term pregnancy prevention, leading to billions of dollars in revenue for manufacturer Bayer within a decade. In October 2009, the FDA revealed that it had received thousands of Mirena side effect complaints on its MedWatch reporting system.

More than 70,000 Mirena side effect complaints were reported to the FDA until 2012, according to the Cleveland-based WEWS channel. Mirena migration, uterine wall perforation, serious internal damages leading to hysterectomy, ectopic pregnancy, miscarriages, and streptococcal sepsis were among the major Mirena IUD injuries identified.

The IUD has also been cited for post-use pregnancy problems, painful ovarian cysts, vaginal infections, angioedema, pelvic inflammatory diseases, and genitourinary problems.

About 47,000 of these reports dated back to timeline from 2007 and 2012. At least 5,000 women suffered due to spontaneous Mirena migration causing device failure, pregnancy, and internal injuries while over 1,300 went for hysterectomy after the displaced IUD significantly damaged their uterus.

Mirena Lawsuits Continue to Increase, Cross 1,050 Mark

Mirena lawsuits have crossed the 1,000 mark and the filing of litigations continues unabated across the country seeking product liability against Bayer Healthcare. With over 70,000 Mirena injury complaints registered on the FDA MedWatch by women impacted by the IUD birth control device, the final tally of IUD lawsuits is expected to be in tens of thousands.

According to the February 2014 figure published by the Judicial Panel on Multidistrict Litigation, at least 408 federal Mirena lawsuits are pending in the New York South District Court of Judge Cathy Seibel for pretrial consolidation. The first federal Mirena lawsuit is expected to go for trial after July 2015.

Meanwhile, another 628 Mirena lawsuits have been filed in the state courts of New Jersey. Bayer Healthcare has its headquarters in Montville township of Morris County in the state. All Mirena lawsuits filed under the state jurisdiction have been assigned to Bergen County Superior Court Judge Brian R. Martinotti.

Mirena Lawsuits Claim IUD Migration, Uterus Perforation

The latest February figures indicate over 20 percent rise in Mirena lawsuits compared to January 2014. Experts expect several thousands of Mirena lawsuits in the coming months. A majority of Mirena lawsuits have been filed after plaintiffs suffered from injuries and internal organ perforations caused by the migration of the IUD inside the body. There were at least 5,000 Mirena migration complaints reported to the FDA in the last five years.

Mirena IUD Litigation: An Update

Earlier, April 4, 2014 was chosen as the date for the selection of federal Mirena lawsuits for the bellwether trial. However, a new order issued by Judge Cathy Seibel on February 26th has pushed back the deadline by 60 days. As a result, the discovery deadline set for September 30, 2014 has also been postponed and the first Mirena lawsuit is expected to be taken up for trial only after mid-July next year.

Mirena lawsuit plaintiffs have sued Bayer on the ground that design defect of the intrauterine device results in its spontaneous displacement and migration against aggressive promotion of the birth control option by the manufacturer as hassle-free and safe. While dislocation leaves users unguarded against the possibility of pregnancy, the migrating IUD damages the uterus and results in other internal injuries.

In a rebuttal to Bayer’s defense that the risk of perforation was included in the labeling information, Mirena lawsuit plaintiffs have termed the warnings as vague, inadequate, misleading, and without any mentioning of the potential IUD migration risk.
