Mirena Migration Warning

The prescription drug injury watchdog DrugRisk published a research report a few weeks ago indicating over 17 percent rise in Mirena migration injury claims. According to its estimates, the total number of injuries is many times more than 6,000 reports received on the MedWatch system as many of the incidents go unreported over the years.

The risk of Mirena migration and associated injuries are also high on the radar of the Society of Laparoendoscopic Surgeons.         Twenty-nine California women have come together to initiate a Mirena injury lawsuit claiming that they suffered from uncommon side effects caused by the contraceptive. She was also found to be pregnant despite having the Mirena contraceptive implanted for more than two years. The woman also had to undergo hysterectomy.

        The Miren lawsuit claims that manufacturer Bayer was aware of the design defect that leads to spontaneous migration of the IUD. However, it never apprised consumers of such serious side effects and continued to market the defective product for commercial gains.

        More Than 70,000 Mirena Injury Reports

        The FDA had received at least 70,000 Mirena injury reports since the IUD was approved in 2000. There were more than 40,000 Mirena side effect incidents, including about 5,000 mirena migration and 1,700 mirena uterine perforation cases, reported on the MedWatch system in the last five years. The following are the most common Mirena contraceptive side effects reported.

          Most Reported Mirena Side Effects

              What is Wrong With Mirena IUD?

              The high rate of injuries makes Mirena IUD an unsafe birth control option. Healthcare professionals have reservations in prescribing the contraceptive for the fear of injury risks. A mother of three had to undergo hysterectomy after the Mirena IUD perforated her uterus. She experienced severe pain after the contraceptive dislocated and perforated her uterine wall. She had to undergo surgeries to remove the IUD. In another case, the Mirena IUD migrated and lacerated the liver of a user.

              Another woman underwent hysterectomy, stomach tissue surgery, and appendectomy after Mirena hormonal birth control was found to have embedded in her uterus. A rare case was reported where the IUD migrated and traveled to the rib cage of a user, who underwent sternotomy procedure – usually conducted in case of an open heart surgery.

              The Centers for Disease Control and Prevention published a survey report in March 2012 disclosing that 60 percent of healthcare professionals preferred other forms of birth control over Mirena IUD while at least 30 percent felt that the manufacturer claims were exaggerated. In December 2009, the FDA had asked Bayer to refrain from Mirena promotional campaigns that presented the IUD contraceptive as the safest birth control option for women of all ages. The annual conference of the American Public Health Association in 2012 also endorsed another study highlighting Mirena side effect dangers. According to it, most of the doctors advised against the use of the IUD by women who are planning pregnancy for the fear of uterus perforation.

                Mirena Lawyer: Federal Cases Now Centralized

                As attorneys that represent women injured by the Mirena IUD, we felt it appropriate to announce that the JPML has consolidated all federal Mirena IUD cases in the United States District Court for the Southern District of New York.  The reason for doing so is that centralization “will serve the convenience of the parties and witnesses and promote the just inefficient conduct of this litigation.”  Plaintiffs in the various Mirena IUD cases have alleged a design defect in the Mirena IUD that can allow the device to dislodge or “migrate” once inserted in patients.  They are accused of failing to warn that users of the device face of risks of migration and subsequent development of medical conditions resulting from uterine perforation.  In some instances, for example, plaintiffs have alleged that complications resulting from their injuries have necessitated a hysterectomy.

                “These actions show common factual allegations with respect to the alleged risks of uterine perforation and migration associated with Mirena and the adequacy of the product’s warning label,” the JPML stated.  “Centralization will eliminate duplicative discovery; prevent inconsistent rulings on pre-trial matters; and conserve the resources of the parties, their counsel and the judiciary.”

                Not surprising for the maker of the medical device, they oppose centralization under Section 1407 arguing that voluntary coordination by the parties is more appropriate in light of factual differences in the cases.  Opposition of consolidation is normal for a medical device manufacturer as centralization allows those injured to level the playing field against a medical device manufacturer that routinely tries to use scorched earth tactics to frustrate and “encourage” injured persons to give up their claims against the medical device manufacturer.

                Mirena was approved as a birth control device in 2000 and later as treatment to control heavy menstrual bleeding.  Approximately two million women in the United States alone are currently using Mirena, and the FDA has been notified of thousands of adverse events associated with the product according to one lawsuit.  However, there, the manufacturer of Mirena has yet to revise its product labeling to reflect the growing number of complaints related to migration and perforation of the uterine lining associated with the IUD.

                  Is the Mirena IUD Medical Device Safe?

                  Mirena contraceptive is a T-shaped plastic intrauterine device containing levonorgestrel, a form of progestogen. The birth control device inserted into the uterus releases 15-40 mcg of levonorgestrel every day. The progestin hormone thickens the cervical mucus while slimming down the uterine lining. This blocks sperm from entering the ovary. The FDA allowed Bayer to introduce Mirena for birth control in 2000 and also approved it for prevention of serious menstrual bleeding in 2009.

                  However, from the very beginning, the Mirena IUD was marred in controversy. At the onset, the FDA advised young women against its use for fear of uterus damage. Reports then also highlighted uterus perforation, complications, and other injuries caused to patients during Mirena IUD clinical trials.

                  FDA Warning: Risks Are There

                  More than 47,000 Mirena side effect complaints received by the FDA between 2007 and 2012 speak volumes of adverse event risks associated with the IUD. In December 2009, the regulator asked Bayer to change its product advertisement that was designed to attract younger women and girls without informing about associated risks. It even dashed a letter to the manufacturer expressing displeasure over contravention of the Federal Food, Drug, and Cosmetic Act.

                  Though the FDA is yet to issue any public alert about Mirena IUD, it has admitted of receiving thousands of adverse event reports. According to a brief released by the regulator in 2009, consumers had infection, infertility, uterine perforation, device migration, pelvic inflammation, and uterus removal surgeries warranted by Mirena IUD in the past.

                  Studies: Doctors Remain Unconvinced

                  While manufacturer Bayer makes tall claims about its IUD contraceptive, we believe doctors in the United States are far from accepting Mirena as a safe and reliable mean for birth control. The Centers for Disease Control and Prevention commissioned a research that reported in March 2012 about overwhelming concern among doctors on recommending Mirena birth control IUD. While more than 60 percent were unconvinced about the hormonal contraceptive as the first choice, more than 30 percent rejected the claims of its manufacturer.

                  The 2012 meeting of the American Public Health Association also cautioned about potential injuries Mirena side effects could spell. It endorsed a finding that showed how fear of side effect risks preventing doctors from suggesting Mirena IUD to woman looking for birth control options.

                  Lawsuits: What Consumers Underwent

                  Hundreds of Mirena lawsuits filed in 17 federal courts and dozens of states courts allege that the IUD is “defective and unreasonably dangerous” and Bayer did not inform consumers about the injuries it could inflict. Most of these product liability lawsuits are filed for uterus perforation caused by the IUD. One of the plaintiffs, a 21-year-old Ohio woman, lost her ability to conceive as the Mirena IUD migrated and damaged her uterus. She was left with no other option but to remove her uterus.

                  Another plaintiff, 24-year-old California resident, underwent similar fate following multiple surgeries to remove the IUD floating in her abdomen. A woman from Winchester, VA, sought $2 million in damages for injuries caused by the IUD. The Mirena contraceptive she had displaced and migrated causing her to suffer from ectopic pregnancy and severe pain.

                    Mirena Migration Lawsuit: The Case of Birth Control Out of Control

                    Once promoted as the safest and the most viable birth control device, Mirena IUD is falling from grace with the FDA receiving thousands of adverse event reports. The increasing number of Mirena lawsuits alleging uterine perforation and permanent injuries caused by the IUD has led to serious apprehensions among consumers about its reliability and efficacy.  While the FDA has received more than 45,000 Mirena side effect complaints through the MedWatch program in the last five years, the medical community looks disconcerted over prescribing the IUD contraceptive.

                    Mirena uterus perforation reports came into limelight in 2009 when the FDA admitted of receiving hundreds of complaints about it. Though the similar adverse events were noticed earlier, it is the 2009 disclosure of the federal regulator that encouraged people at large to file Mirena perforation lawsuits. One of the Mirena lawsuits filed in November 2012 claimed that the plaintiff, a 21-year-old woman from Ohio, could not be a mother because of permanent injuries caused by the IUD device migration and perforation. She had to remove her uterus after it was found to be punctured by the Mirena device she had. The lawsuit has sought millions of dollars in compensation from Bayer alleging that the manufacturer did not inform consumers about such potential side effects.

                    Mirena lawsuits have also been filed by two women in a New Jersey court in May 2012 with similar claims. Both had to undergo hysterectomy and remove their uteruses following damages caused by Mirena IUDs. A Mirena lawsuit filed in a Virginia court has made a staggering demand for $2 million compensation on the ground that the plaintiff had suffered from permanent injuries caused by the birth control IUD. The plaintiff was implanted with Mirena IUD at Winchester-based Blue Ridge Gynecology and Obstetrics in September 2006. She was diagnosed with ectopic pregnancy and severe pain in the abdomen within months attributed to Mirena IUD migration.

                    At least five-dozen Mirena lawsuits filed in 17 U.S. federal courts are now consolidated under the MDL provision at a New York south district court. Almost similar numbers of cases are also awaiting trial in various state courts.

                    According to Mirena migration lawsuits and complaints to the FDA, the IUD displacement led to major health problems and injuries, such as

                    • Perforation of uterus, fallopian tube, ovarian wall, and other pelvic organs
                    • Surgical removal of uterus punctured by the IUD displaced
                    • Internal injuries caused by the floating IUD
                    • Failure of the birth control device leading normal or ectopic pregnancy
                    • Multiple surgeries to remove the displaced contraceptive device and repair injuries

                    What FDA and Doctors Say

                    Mirena was approved by the FDA in 2000 with a rider that it was not safe for women yet to become mothers. The federal regulator was worried over uterus and other pelvic infections caused by the IUD during clinical trials. In October 2009, the FDA acknowledged of receiving large number of complaints involving the Mirena IUD. After two months, it issued a warning restricting manufacturer Bayer from the run-away promotion of the contraceptive without making people aware of Mirena side effect risks. Subsequently, it was included in the “Bad Ad Program.” A met-analysis published in 2013 made it public that 47,506 adverse events reported to the FDA between 2007 and 2012 were about serious health problems caused by the birth control IUD.

                    Successive surveys conducted in 2012, by the Centers for Disease Control and Prevention and the American Public Health Association, highlighted widespread hesitation among doctors to consider Mirena a safe and secure birth control option.

                    Another Case of Birth Control Out of Control

                    The rising number of Mirena lawsuits is a grim reminder of the turbulent consumer history of hormonal copper IUDs in the United States. In 1985, A. H. Robins was forced to pay $3 billion in damages after 300,000 lawsuits were filed by consumers who suffered from serious side effects, including death, caused by its Dalkon Shield IUD. Similarly, more than 1,000 product liability lawsuits were filed against G. D. Searle & Co for injuries caused by its Copper-7 birth control IUD. A Minneapolis woman won $8 million in damages.
